One day? After all the shit DRM Ubisoft loaded into the game, and they still only managed one day? I really hope we see a few suicides at Ubisoft in the coming weeks. They should be ashamed.

Word is: "Please know that this rumor is false and while a pirated version may seem to be complete at start up, any gamer who downloads and plays a cracked version will find that their version is not complete."

1.1 Update by Skidrow is already in the tubes, but it's simply cracked 1.1 official patch, not a fix / prop...

So Ubisoft released 1.1 patch at the day of premiere and hoped that this will trick teh pirates.

My guess is they either:

A. Got the game early. Stores have them in stock a week or two ahead of time, all it takes is one guy who knows a guy who works at a retail store somewhere. The most probable option.
B. Got a leaked beta version of the game which didn't have the DRM in it. Rare, but quite possible. Ubisoft surely doesn't have the DRM enabled when they were developing the game. This is why you see so few beta's for games these days, devs are afraid you will take the non-DRM'ed beta *.exe as an almost already pre-made crack.
C. or Ubisoft just really, really sucks at making effective DRM. Unlikely for most games nowadays, but Ubisoft could certainly find a way to fuck it up if they really tried.
