It's in-game art, posed and rendered in 3D Studio Max. The magazine also retouched the image for the magazine. All of the covers were done this way.

I actually think the in-game rendering looks better, because you can't see all the shaders in action when we render in Max.

Steve "MrSmileyFaceDude" Meister informed us and Duck & Cover that he's written an article on the combat in the next title in the Elder Scrolls series, Oblivion. Here's a very interesting bit on yielding and the non-lethal combat present in the game:

And finally, combat need not be lethal. Any combatant - including the player -- can yield to their opponent. It's up to the opponent to accept the yield or not, but if they do accept, combat ends. It's a way to get out of those sticky situations where you find yourself in over your head. Just don't try it with a creature or with anyone who really, really hates you! And if an NPC yields to you, you make the call - walk away, or keep fighting.
It'll definitely eliminate the need to reload the game whenever you find yourself in an awkward situation with a sentient enemy. Reloading always destroys immersion.

I stumbled upon this thread in one of my recent searches and decided to necro it bring it back for greater lulz.

(start from the beginning for most gratification :smug: )

meh... the devs posts were kinda interesting but I'm to new 'dex to enjoy the rest.

Looking back the game delivered pretty much what he said it would and to be honest it sounded like crap even coming from him.

You mean NPCs could yield too, and yielding was an actually meaningful feature with actual gameplay implications rather than isolated "sorry I hit you!" button working as quick fix for allies jumping on player's sword?

Did enemies ever actually yield in Oblithering? I don't remember it ever working when you did it, either.

No. Not even mods included that feature. Only you could yield, and only to non-hostile people like guards or townspersons anyway.

If Oblivion had had about half the features it was supposed to, it'd have been awesome.

I like how the Bethesda dev bailed just a few months before the lynchings were due to begin
