According to the <a href=http://www.ocregister.com/ocr/2004/06/20/>Orange Country Register</a>, 20 employees who haven't been paid for weeks finally figured out that something is wrong and filed complaints. The state ordered Herve to show up with the payroll records, but that crafty bugger claimed that a dog ate them. The state officials are now looking for that dog.

The company had let its workers' compensation insurance lapse, causing the state to shut the business down two weeks ago until Interplay renewed coverage a few days later. Employees say that they haven't been paid since April.

Herve Caen, Interplay's CEO, missed two meetings with the state investigators this week, said Dean Fryer, a spokesman for the California Labor commissioner. The state has now ordered Caen to show up for a meeting Monday, equipped with Interplay's payroll records. Caen told investigators Thursday that he no longer has access to the records because they are on computers that have been put in storage, Fryer said. "This doesn't release him from his past responsibilities," Fryer said. "It seems to me that he could just plug in a computer and get the records."

Caen could not be reached Friday for comment. Earlier this week, Interplay spokesman Luke Haase said the company is still seeking more funding. Paying employees will be a priority, he said.

If Caen fails to deliver the payroll records and pay employees, the state will move forward and hold formal hearings, Fryer said. The state could also put liens on Interplay's assets or turn the case over to the Orange County District Attorney's Office.

The computer is in storage so he can't get to the records. Thats pretty weak even for him. Is it in storage in a pocket dimension which only opens every 99 years?

No, its probably in his garage doused with petrol with faulty wiring anywhere just waiting for someone to turn on the lights.

i doubt they'll be freezing his assets, since accounts in the cayman islands are hard to get at. once the labor dept. gets involved and finds out he's been deducting for benefits but not providing benefits, it'll be interesting to see which indictments they shoot for first...

He will become a mythical figure when he escapes from the United States. Every two-bit game-journalist will hunt him down. I suppose the only way they could stay a float would be to sell has many of it's properties has possible. He's fighting a losing battle though, he might has well either give up or get the hell out of the country.

unfortunately, incompetence is rarely an impeachable offense. gross negligence or a felony are usually required (assuming he was appointed as opposed to elected).

Does Lance Ito still work as a judge BTW?

He's been reelected TWICE to the bench since the verdict.

Makes my stomach percolate just thinking about it.

The judge didn't bring in the verdict. It was the people on the jury. Which just reinforces that the day that LA finally falls into to ocean, it may just make this world a little bit better.

I had a law professor who said that the reason that the jury on the trial (one of the main reasons he said) did what it did was because the prosecution showed pictures of the dead bodies to the jurors (throat wounds and all), which was allowed by the judge. Apparently, some of the members of the jury were moved to tears, some became very ill. No self respecting judge would ever allow murder photos to be shown to a jury.

I'm curious... why did he say the murder photos led to acquittal? In my mind, seeing grisly murder photos would make people angry and more likely to want to throw the bum in jail and lock away the key.

That wouldn't work so well these days with everyone sending pictures they downloaded off Ogrish to each other in e-mails.
