I'm no expert on these matters, but to me it sounds like Ubisoft basically won. They got the lawsuit withdrawn, held the IP hostage for three years, and gave it back to Desilets only now that he went indie and is thus no longer capable of making the AC killer he originally wanted this game to be - not to mention that the entire "AC killer" ship has long since sailed, too.
More importantly, they avoided a legal decision (which this guy certainly would have won) which would have allowed other people to short-circuit the lengthy legal hell of obtaining IP that was "cancelled" instead of cancelled so they can use this same trick again with their other contracts.
