The only "reasonable" excuse is they are planning to release a "remastered" version of the old game in the near future. I don't think they're doing this, since Activision holds rights to it.

I also don't understand why the creators are bound to CCP's request - it's the goddamn internet. Do what you have to do to keep yourself legally protected, but you don't need to go above and beyond. Privately release the source code at the very least. CCP does not deserve anybody's respect after this.

I do wish more unofficial remake teams used the "Black Ops" method of development. Work on the game privately, and release it when it's done as a de facto accomplishment. That's how the NewDark patch for Thief and SS2 was made.

It's not always that simple though, since they often need some publicity to attract talent and testers.

Anything (except satire, reviews and citation-like stuff) that include touching copyrighted content is illegal without written approval from owner: (I'm using art as example but it applies to other types of projects) selling any fanarts is straight illegal and can end in the court, but also drawing these fanarts and showing it on internet is almost in every case illegal and can cause C&D (but nobody cares usually, also it would be bad for copyright holder's PR, ex. Blizzard approves fanarts, because it will cost them more to lost fans because of lawsuits than they lose due to copyright violations by fans). Mods made in official tools are obviously legal and nobody need to ask for approval, in other cases it is only good will of publisher. IMO hexer is on the way to receiving C&D because he is writing from time to time about evidently illegal & rather stupid stuff like crowdfunding or paing his slaves team monies for work. Somebody should explain this to him maybe?

Two things:

1) You're forgetting fair use.

2) If they didn't include actual art portion, but it was just an empty game and used the original vtmb assets they should be fine.

according from some source on IRC from 20th November Lucius is still coding away on DaggerXL.

Up-porting Bloodlines seemed to me like the kind of fun little project if you were a kid with time on your hands to mess with stuff, but it's useless practically speaking.

I think the point here is not whether this particular remake was worthwhile or not - I agree that it was pretty pointless - but rather, publishers sending C&Ds to non-commercial fan projects that wouldn't have done them or anyone any harm.

What if they continue working on it, but don't acknowledge it and don't talk about it? Then they release their thing on torrents when it's done. What's the problem here?
